OPINION
FABER, District Judge.
I. Statement of the Case
The plaintiff, Lucian D. Green, Jr., filed this civil action pursuant to 42 U.S.C. § 1983 seeking damages against the City of Welch, West Virginia, and one of its police officers, L.T. Vaseleros, for an alleged deprivation of his constitutional rights. Essentially, the plaintiff contends that he was arrested without probable cause and falsely imprisoned by Vaseleros, who was acting pursuant to a custom or policy on the part of the City of Welch authorizing its policemen to make warrantless arrests on citizens’ complaints.
