This suit was'instituted in the district court of Travis county, Tex., June 12, 1913, by the Concrete Investment Company against the International & Great Northern Railway Company. The parties will be designated here as in the trial court.

On January 13, 1908, the International & Great Northern Railroad Company procured a loan of $50,000 from the National Bank of Commerce of St. Louis, Mo., and delivered to that bank its two notes of that date, due six months after date, each for $25,000.
