Badt, J.:

This is an original petition for a writ of mandate (after denial by the First Judicial District Court, Richard R. Hanna, judge, of an identical petition) directing the issuance to petitioner by respondents of a certificate of election as assessor of Ormsby County.

Petitioner and Lester V. Smith were candidates for such office at the general election held November 4,1958. Smith died October 21, 1958 while he was serving as sheriff and ex-officio assessor. His death received wide publicity and most, if not all, electors voting at said general election had knowledge…
