James Mason, plaintiff-appellant (“Mason”), filed an action in common pleas court against his former employer, United States Fidelity and Guaranty Company, defendant-appellee (“USF&G”). Originally the complaint alleged two causes of action against USF&G but one was dismissed, and only an action for intentional and/or negligent infliction of emotional distress has been preserved on appeal.
