MEMORANDUM & ORDER
WALKER, District Judge:
Plaintiff, Jose Ventura, has brought this action pursuant to 42 U.S.C. §§ 1981 and 1983, as well the Fourth and Fourteenth Amendments to the United States Constitution, claiming that defendants violated his civil rights by failing to enforce proper policies in conducting drug testing of all employees. Plaintiff has moved pursuant to Rule 23(b)(2) of the Fed.R.Civ.P. for an order certifying the action as a class action on the grounds that defendants have acted on grounds generally applicable to the class, making final injunctive relief appropriate.
