Parties appear in the same order as in the trial court, J. F. McKeel being the principal plaintiff, and others nominal plaintiffs. Mercer, the principal defendant, was in possession of SO acres, purchased by him -in'1921 at guardian sale from Catherine Virginia Payne and Consuelo Payne, enrolled Creek freedmon. In April of 1921, Mercer contracted with Westheimer & Daube. of Ardmore, to deliver to them an oil and gas lease cm the premises for $4,000 bonus, upon approval of title, the money being placed in escrow in a bank at Ada.
