Affirming.
This is an appeal from a judgment by which the appellees, Mary C. Downey, a lunatic, and Lloyd W. Grates, her brother and . present committee, were awarded $10,000 with interest at six per cent per a.nnnwi from the date of the judgment against the estate of Charles Downey, deceased, former committee of his wife, Mary C. Downey, and against the appellant as .surety on his bond, for assets of Mrs. Downey’s estate received by her husband and committee and not accounted for. No appeal is prosecuted by the estate of Charles Downey.
