Suit by plaintiff against defendant for false imprisonment.

Defendant in bis answer denied that tbe imprisonment was unlawful, and set out therein that be was acting as a peace officer (chief of police of the town of Jerome), and, as such, arrested and imprisoned plaintiff in the town jail for vagrancy, as defined in *181Ordinance No. 88 of the town of Jerome, and that plaintiff was found guilty thereof and sentenced. He also demurred to plaintiff’s complaint as not stating a cause of action. Demurrer was overruled, and, upon a trial before a jury, plaintiff obtained a verdict and judgment for…
