OPINION

HERNANDEZ, Judge.

This is an interlocutory appeal brought pursuant to Section 21-10-3, N.M.S.A.1953 (Repl.Vol. 4, Supp.l973) by Universal Constructors, Inc. (Universal) appealing the order of the trial court striking a defense to the first amended complaint of the plaintiffs (Harrisons) and the complaint of the involuntary plaintiff, Interinsurance Exchange of the Automobile Club of Southern California (Interinsurance).
