This action was brought on a policy of insurance covering plaintiff’s dwelling house, which was destroyed by fire on May 1, 1928. The answer alleged that prior to the fire the policy had been can celed and terminated for plaintiff’s failure to pay an assessment. There was a trial by the court without a jury. In substance these were the findings: Defendant was organized in 1882, under the act of 1875 authorizing the formation of town insurance companies.
