OPINION AND ORDER

ROBERT P. PATTERSON, Jr., District Judge.

Plaintiff applies pursuant to Rules 15(a) and (b) of the Federal Rules of Civil Procedure to amend the ad damnum to reflect a claim for punitive damages and to amend its complaint to increase its claim for compensatory damages to 4 million dollars. Plaintiff’s present ad damnum is for 1 million dollars in compensatory damages. Such amendments are to be liberally permitted unless there is prejudice to a party. Foman v.
