Edward Welton was the owner of a Cadillac touring car in which he unlawfully transported intoxicating liquor from points in the Dominion of Canada to the city of Omaha in the state of Nebraska. On a prior trip and on the trip here in question, he hired August Ernst, for $100 per trip, to go with him as a mechanician and keep the car in good running order. On the trip here in question he loaded his car with whiskey at Bienfait, Canada, and started for Omaha accompanied by Ernst.
