This appeal arises out of an equitable action on a written contract for the sale of standing timber to be severed by the purchaser. Because of numerous alleged breaches of the contract, plaintiff, the vendor, sought to have the contract cancelled and requested further relief by way of injunction, damages, and an accounting. Pending decision on plaintiff’s motion for an order to show cause why a temporary injunction should not issue, the court issued an order temporarily restraining defendant from cutting or removing any more timber or lumber from plaintiff’s land.
