THIS MATTER comes before the Court on: (i) the Defendant’s Motion for Summary Judgment, or, in the Alternative, for Certification to the New Mexico Supreme Court, filed May 23, 2006 (Doc. 14)(“Defendant's Motion for Summary Judgment”); and (ii) the Plaintiffs Motion for Summary Judgment, filed May 30, 2006 (Doc. 16).
