MEMORANDUM OPINION AND ORDER
GUZMAN, District Judge.
Heather Ploog (“Ploog”) has sued First Chicago NBD Mortgage Co.’s (“First Chicago”) for breach of contract and breach of fiduciary duty and ■ has sued HomeSide Lending, Inc. (“HomeSide”) for violating the Cranston-Gonzales Amendments to the Real Estate Settlement Procedures Act (“RESPA”), 12 U.S.C. § 2605 et seq., as well as for negligence, and breach of fiduciary duty.
