I. INTRODUCTION
The matters before the Court are the Motion for Partial Summary Judgment filed by the Plaintiff, Pearl Maxwell (“Maxwell” or the “Debtor”); and the Opposition to Debtor’s Motion for Partial Summary Judgment and Cross-Motion for Summary Judgment filed by the Defendant, Fairbanks Capital Corporation (“Fairbanks”).
