JACKSON, Chief Justice.

This suit was instituted by the appel-lee, W. W. Humphrey; in the District Court of Garza County against the appellant, Texas Employers’ Insurance Association, to set aside an award of the Industrial Accident Board on his claim for compensation on account of accidental injuries he alleges he sustained on July 14, *3141938, while in the employ of the Pos.tex Cotton Mills which he asserts carried insurance with appellant for the protection of its employees.
