JACKSON, Justice.

This suit was instituted 'by N. B. Horn, ap-pellee, against the Texas Employers’ Insurance Association, appellant, to set aside the decision of the Industrial Accident Board on his claim for compensation and to recover for accidental injuries he alleges he sustained on October 31, 1931, while employed by L. E. Whitham & Go., a corporation, which carried insurance with appellant for the protection of its employees.

The appellant answered by general demurrer and general denial.
