NORTHCOTT, Circuit Judge.

This is an action at law brought by the appellee, Mrs. Odell Elliott Pfaff, here referred to as the plaintiff, in the District Court of the United States for the Western District of South Carolina, at Green-ville, against the appellant, United States of America, here referred to as the defendant, in which action the plaintiff sought to recover on a war risk insurance policy issued to one DeWitt Elliott.
