Plaintiff, a contractor, agreed to erect a building for Jacob Waidelich in the City of Allentown. The contract was oral and required plaintiff to furnish materials and labor on a cost-plus basis, at current market prices plus commission as compensation for his services. Waidelich died shortly after completion of the building • and plaintiff then filed a lien for the balance claimed to be due him.
