It is contended, in the first place, that the judgment should be reversed because it does not appear from the transcript that the indictment upon which the defendant was tried and convicted was found and returned by the grand jury in the manner provided in chapter VII of the Criminal Code. This chapter provides that an indictment, when found by the grand jury, must be presented by the foreman in their presence, filed with the clerk, and remain in his office as a public record.
