Appeal from a judgment of the superior court for Skagit county, Joiner, J., entered January 14, 1904, upon findings in favor of the plaintiff, after a trial before the court without a jury, in an action for damages for the commission of rape.

The defendant was convicted of the crime of rape, committed upon his minor daughter, Lulu Roller, and was sentenced to a term in the penitentiary at Walla Walla. This action was commenced by the said Lulu Roller for the purpose of recovering from said defendant damages for said rape, in the sum of $2,000, and the homestead of the defendant, upon which the minor children of the defendant were residing, was attached. The said Lulu Roller, at the time of the commencement of this action, was fifteen years old. The homestead in dispute was the community property of Roller and his deceased wife,…
