DOYLE, Judge.

Before us is an appeal by the City of Harrisburg from an order of the Court of Common Pleas of Dauphin County which granted a preliminary injunction restraining the City from ceasing its practice of transporting prisoners from and to preliminary arraignments and preliminary hearings.

The case history is as follows. In Dauphin County all prisoners, regardless of the criminal charges placed against them, have been transported to their preliminary arraignments and preliminary hearings by the police department that filed the criminal charges. For years the City of Harrisburg…
