These two cases were tried together in the court below and will be disposed of in one opinion.
The Western and Southern Life Insurance Company and the Prudential Life Insurance Company each issued what is called a double indemnity (in case of accidental death) insurance policy on the life of John H. Speer. Each policy named as beneficiary Esther F. Speer, the mother of the insured. The insured died and the respec tive insurance companies paid the straight life insurance loss, but refused to pay the accidental death benefit. The beneficiary brought separate suits against…
