A constitutional attack on Fed.R.Civ.P. 25(c) has resulted from a transfer of ownership of patents between parent corporation and wholly owned subsidiaries during the course of patent litigation. Defendant, Globe-Union Inc. (“Globe I”), on September 7, 1982 filed a motion under Fed.R.Civ.P. 25(c) to change the name of the original defendant to Johnson Controls, Inc.
