GIBSON, C. J. —

The plaintiff brought this action as administratrix of the estate of Emilie Rust, deceased, to set aside a judgment rendered against Emilie Rust prior to her death. The judgment was in favor of defendant as administratrix of the estate of Hattie Haas in an action to reform a deed in which Hattie Haas and Emilie Rust were named as joint tenants. The plaintiff, Marguerite Olivera, and Hattie Haas were daughters of Emilie Rust, and the defendant, Rosaline Grace, is the daughter of Hattie Haas.
