The defendant, Roger W. Cunningham, was charged in the district court of Oklahoma county with the offense of murder, was tried, convicted and sentenced to death by electrocution in the state penitentiary, and has appealed.

This case was submitted to this court on the case-made with petition in error attached. No appearance was made at the time the cause was set for oral argument by either the state or the defendant, and no briefs have been filed.

The only deifense interposed in the trial of said case was the defense of insanity. The defendant contends in his petition in error before this court…
