(after stating the facts as above). Thomas Fritz, the plaintiff in error, was tried, convicted and sentenced to be executed for the crime of murder committed upon one Walter R. Watson September 14, 1910. The information was presented and the defendant duly arraigned in the district court of Muskogee county on September 24, 1910, and was by the court given until September 28th to enter his plea thereto.
