Appeal from, District Court, Cherokee County; ■ John H. Pitchford, Judge. A. L. Owen was convicted of murder, his motion for new trial was overruled, and he brings error.

The plaintiff in error, Owen, was, by information duly filed in the district court of Cherokee county on the 23d day of August, 1916, charged with the crime of murder, alleged to have been committed in said county on the 4th day of May, 1916, by shooting one Lizzie Morgan with a pistol. On September 4th following he was arraigned, and on the 6th day of September he was put upon trial, which resulted/ on the 8th day of September, in a verdict of guilty of murder and fixing the penalty at death. On September 12th his motion for new trial was overruled and judgment rendered on the verdict, and…
