The plaintiff in error, Jack Anthony, herein referred to as the defendant, was convicted of wife murder and his punishment assessed at death on an information filed in the district court of Muskogee county on the 14th day of September,. 1915, wherein it was charged that the said Jack Anthony, in said county, on the 12th day of June, 1912, did kill and murder one Nancy Anthony, by shooting her with a pistol.
