Blake, J. —

Plaintiff brought this action to recover damages for personal injuries sustained when he collided with an automobile driven by defendant. The cause came on for trial before a jury. At the close of plaintiff’s case, defendant interposed a motion for non-suit, which the court granted on the ground that plaintiff was guilty of contributory negligence as a matter of law. From a judgment dismissing the action with prejudice, plaintiff appeals.
