VAN DUSEN, Circuit Judge.

This appeal asks reversal of a district court order granting a Motion to Dismiss this Wrongful Death and Survival suit which was brought for the death of an unemancipated minor child allegedly caused by his father’s negligence. The appellant is the administratrix of Timothy U. Basti, a deceased minor, who died as a result of an automobile accident September 28,1965. The appellee, defendant below, is Dominic F.
