This is a suit to obtain payment of the proceeds of a $5,000 insurance policy. Federal jurisdiction is founded on diversity of citizenship, and, for present purposes, South Carolina law is controlling. We granted certio-rari 2 in order to determine whether the Circuit Court of Appeals’ refusal to follow the only South Carolina decision directly in point, the decision of a Court of Common Pleas, was consistent with the Rules of Decision Act 3 as applied in Erie R. Co. v. Tompkins, 304 U. S. 64 (1938), and subsequent cases.
