DIETRICH, Circuit Judge.

This is an action in ejectment, brought to determine the right of possession to certain mining ground for which defendant had filed patent applies tion. From a judgment on the verdict in favor of defendant, plaintiff brings error.

The mining ground in controversy is in the Fairbanks recording district, Alaska, and was in possession of a third party under a prior location up to 12 o’clock midnight July 1, 1921, at which time, because of his failure to do the requisite assessment work, the owner’s right expired.
