for the Court.

The defendant, Frank C. Vieira (defendant), appeals from a Superior Court judgment, finding that he violated the conditions of probation imposed in conjunction with a suspended sentence. This case came before the Supreme Court for oral argument on September 26, 2005, pursuant to an order directing the parties to appear and show cause why the issues raised in this appeal should not summarily be decided.
