HANSON, Justice.

In the year 1923 an action was commenced in the district court of Washington county by the St. George & Washington Canal Company against the Hurricane Canal Company to quiet title in plaintiff to certain waters of the Virgin river water system. In that action, the proceedings provided by chapter 67, Laws of Utah 1919, particularly sections 22 and 38 thereof, now sections 100-4-3 and 100-4-18, R. S. Utah 1933, for the determination of water rights in a water system, were invoked. In accordance therewith, the state engineer proceeded, as required by the statute, and submitted…
