This is an appeal from a judgment awarded to plaintiffs upon a promissory note executed by the defendants for $20,000.

The execution of the note was admitted, but defendants claimed that it was conditionally delivered to plaintiffs to become their property in case the defendants, L. C. Riley and Fred Taintor, should exercise an option given them to purchase certain shares of the capital stock held by plaintiffs in the Producers Oil and Gas Company; that the execution of the note and the option agreement constituted a part of the same…
