This matter is before this Court on the Plaintiffs motion for summary judgment. The Plaintiff initiated this adversary proceeding by filing a Complaint against the Debtor alleging that the debt owed to the Plaintiff, evidenced by a state court default judgment against the Debtor for the wrongful death of the Plaintiffs wife resulting from an accident in which the Debtor was driving while intoxicated, is nondischargeable under § 523(a)(9).
