In this accelerated calendar case, submitted on the record and the briefs of the parties, appellant, Altercare of Westerville, Inc. (“Altercare”), appeals from the judgment of the Portage County Court of Common Pleas entered on September 15, 1999. The court denied Altercare’s motion to stay proceedings in which it and Hummel Construction Company (“Hummel”) were named as defendants by appellee, Owens Flooring Company (“Owens”), while Altercare and Hummel pursued court-ordered arbitration.
