OPINION
STAPLETON, District Judge:
This patent infringement action seeks enforcement of United States Patent No. 2,950,228. Plaintiff and defendant are Delaware corporations. Jurisdiction is conferred by 28 U.S.C. § 1338(a) and venue by 28 U.S.C. § 1400(b).
In its complaint, CPC International, Inc. (“CPC”) alleges that it is the owner of the patent-in-suit and that Standard Brands Incorporated (“Standard Brands”), “has been and still is infringing” it.
