OPINION AND ORDER
CONNER, District Judge:
This action for alleged infringement of U. S. patent No. 3,339,378 issued to Francis Chirol of Paris, France (“Chirol”) on a process of mounting precious stones and the resulting jewelry articles (the “Chirol patent”) is before the Court on defendants’ motion for summary judgment on the ground that the Chirol patent is invalid or unenforceable because of fraud or inequitable conduct in the prosecution of the applications for said patent.
