MEMORANDUM OPINION
(August 4, 2010)
Presently before the Court in the above-captioned matter1 are two motions: 1) “Defendant Adlah Donastorg’s Motion to Dismiss Criminal Information Based Upon Malicious Prosecution and Egregious Prosecutorial Misconduct in Violation of his Due Process Rights” (“Defendant’s Motion to Dismiss”); and 2) “The Government’s Motion for Expert Testimony Pursuant to FRE 702” (“People’s Rule 702 Motion”).2 For the reasons set forth herein, the Defendant’s Motion to Dismiss will be denied, and the People’s Rule 702 Motion will be granted, subject to the conditions…
