OPINION

FIRESTONE, Judge.

This case arises from the suspension of an airworthiness certificate issued by the Federal Aviation Administration (“FAA”),1 which prior to its suspension allowed the plaintiffs helicopter to be used for commercial purposes. Count One of the complaint filed by the plaintiff, Mike’s Contracting LLC (“Mike’s Contracting”), alleges a taking of the plaintiffs property without just compensation in violation of the Fifth Amendment of the U.S. Constitution resulting from the FAA’s suspension of the certificate of airworthiness of its helicopter.
