Appellant in this action was prosecuted by the district attorney of San Bernardino County on an information filed July 10, 1939, charging grand theft under section 484 of the Penal Code, as follows: that on the 26th day of January, 1937, in the said county of San Bernardino, State of California, he did “wilfully, unlawfully and feloniously take the personal property of the State of California, to-wit: the sum of $235.67 ... ”, After a plea of not guilty and a trial by a jury, a verdict of guilty with recommendation for leniency was rendered.
