On November 19th, 1942, complainant filed its bill to foreclose a mortgage on premises located in the City of Long Branch owned by the defendant Howland and occupied by the defendants Marinello as tenants. Final decree of foreclosure was entered on January 9th, 1943, and pursuant thereto the mortgaged premises were sold by the sheriff of Monmouth County on February 23d 1943, to the complainant. The sale was duly confirmed by order of this court dated March 6th, 1943, and on March 16th, 1943, the sheriff executed and delivered to the complainant a deed for said premises.
