In Equity. Suit by the Oval Wood Dish Company and Seth H. Smith against the Sandy Creek, 2T. Y., Wood Manufacturing Company for infringement of certain patents relating to wooden dishes.

COXE, District Judge.
This is an equity action, based upon three letters patent, granted to Seth H. Smith and now owned by the complainants. A fourth patent, No. 322,017, granted July 14, 1885, to Smith for a knife for cutting dish blanks, is included in the bill, but the court decided at the argument that it was not infringed. The action is, therefore, upon the other three.
The first of these, No. 273,773, was granted March 13, 1883, for a wooden plate. The application was filed November 22, 1882. ■The second, No. 276,198, was granted April 24, 1883, for a machine for cutting wooden plates.…
