Chief Justice VALDEZ.

Upon consideration of the State’s motion for rehearing, we deny the motion, withdraw our opinion of January 15, 2009 and substitute the following in its place.

After the trial court denied his motion to suppress, appellant, Douglas Michael Hubert, pleaded guilty to the offense of unlawful possession of a firearm by a felon. See Tex. Penal Code Ann. § 46.04 (Vernon Supp.2008). In accordance with a plea bargain, the trial court signed a judgment of conviction that sentenced Hubert to five years’ imprisonment. By a single issue,…
