CUMMINGS, Circuit Judge.

After a full trial the district court, D. C., 350 F.Supp. 1015, entered judgment for the defendant and dismissed this patent infringement suit, holding that the patent sued upon was invalid for obviousness and that in any event the patent was not infringed. This appeal followed.

On November 25, 1958, patent No. 2',-861,688 was issued to Harold H. Harms for his liquid clarification system. After two earlier applications relating to this structure had been abandoned, Harms filed an application for the present patent in December 1955. In August 1957, Harms assigned all his…
