The defendant was convicted of murder in the second degree on an indictment charging him with murder in the first degree.

The defendant’s appeal (G. L. c. 278, §§ 33A-33G) is based on two grounds: (1) “that the finding of malice, implicit in the murder verdict, was most inappropriate,” and thus this court, in the proper exercise of its powers under G.
