This is an indictment for murder. After our decision on a motion for bail, 343 Mass. 162, the defendant was tried and found guilty of murder in the first degree with a recommendation by the jury that the sentence of death be not imposed. He was sentenced to life imprisonment. G!. L. e. 265, § 2 (as amended through St. 1956, c. 731, § 12). In response to a motion for particulars the Commonwealth specified that the murder was committed at or near Horseneck Beach, Westport, between 5 p.m:. and 7 p.m. on June 10, 1961, by discharging a firearm into the body of Herbert J.
